Terms and Conditions

We are happy that you have chosen Omnia Travel as your travel agency. The below terms and conditions ("Terms") shall form an agreement between Omnia Travel & Consultancy LLC, a company limited by shares registered in Sharjah Media City, Sharjah, UAE ("Omnia Travel," "we," "us," "our" and/or the "company") and you, the customer ("Customer" and/or "you"), wishing to avail any of the services sold by Omnia Travel ("Services").

Upon commencing your use of our Services, these Terms and Conditions shall form a binding agreement between us and you. It shall be your responsibility to periodically review these Terms and Conditions to familiarize yourself with them and to make sure they have not changed (as we reserve our right to make changes from time to time without prior notice to you). By continuing to use our Services, you are agreeing to these Terms and Conditions in full. You may not use and shall immediately discontinue your use of our Services, if you are not able to create a legally binding agreement in accordance with applicable laws and/or if you do not agree to these Terms and Conditions in full.

In some cases, Omnia Travel may choose to provide a translated copy of these Terms and Conditions in Arabic (or any other language), but all of our communication with you and any documentation given to you, shall be in English. In case of a conflict between the translated version of these Terms and Conditions and this English version, this English version shall prevail.

THIRD PARTY TERMS AND CONDITIONS

Certain features of our Services may be subject to additional Terms and Conditions from third party service providers (i.e., Suppliers (defined below)). We do not employ such Suppliers and any provision of services by such Suppliers may be subject to their terms and conditions. It shall be your responsibility to inform yourself of such Suppliers' terms and conditions before availing a Service from us (including but not limited to their terms and conditions as they relate to payment, cancelation, and liability). Terms and conditions may differ from Supplier to Supplier and may be amended without prior notice to you. Such terms and conditions shall form an integral part of these Terms and Conditions and any such Supplier shall have the right to enforce such terms and conditions against you.
    
TRAVEL DOCUMENTS AND INSURANCE

It is the responsibility of each Customer to obtain and carry a valid form of identification (Identification card or passport as applicable) and all other documents required aby applicable government regulations before attending the tour, flight, transfer or hotel stay. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records. Omnia Travel strongly recommends that you take into account that certain countries will not admit a passenger, if their passport expires within six (6) months of the date of entry. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. Check each third party booking website to ensure you and all members in your travel group or party obtain and carry travel documentation required. When you receive any and all travel documents, it is the sole responsibility of the customer to review and verify all information. Contact Omnia Travel immediately if changes or corrections are required.
   
If a passenger fails to provide the requested documents, the Service will not be provided and there will be no refunds available. Similarly, in the event of lost or stolen personal documents, Omnia Travel will not be held liable and there will be no refunds provided.

It is advisable that each passengers holds travel insurance policy that includes the compensation in case of any unforeseen events such as: injury, death, illness, loss of baggage, trip cancellation, etc. Omnia Travel is not responsible for any compensation is such events.

RISKS/SAFETY

Travel to certain destinations may involve greater risk than others. Omnia Travel urges customers to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by relevant governments prior to booking travel to any destinations.

By offering for sale travel to particular destinations, Omnia Travel does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. Customer's participation constitutes acceptance of such events at customer's own risk.

VISA/HEALTH/OTHER TRAVEL DOCUMENTATION REQUIREMENTS

Each Customer is responsible to make absolutely certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. Omnia Travel shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by Customer's health practitioner on a valid vaccination certificate, which the Customer must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. For further information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), visit the relevant government website on a regular basis for information regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s).

Omnia Travel neither controls nor warrants the issuance of visas related to applicable travel. Should a visa not be issued, Omnia Travel is not responsible for lost payments made toward the contemplated trip.

LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE

Omnia Travel acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services ("supplier(s)"), and is not the source or provider of the travel services. Each of these supplier companies is an independent entity with its own management, and is not subject to the control of Omnia Travel. Customer is advised that the suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and consents to the use of those suppliers, and understands and agrees each supplier's terms and conditions are contained in printed form and are set forth on their respective websites, which govern the transaction. All bookings are accepted by Omnia Travel as agent for the Suppliers on your itinerary. The transportation, accommodations and other services provided by the identified sea, ground, and air operator suppliers offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including terms and conditions on their respective websites, because Omnia Travel acts as agent for disclosed principal suppliers, and does NOT have the right to control the operations of such independent operators and suppliers, you agree Omnia Travel is not liable for any personal injury or property damage, which may arise out of these services. Omnia Travel hereby disclaims any liability whether based on contract, tort, or otherwise, including without limitation liability for any direct, indirect or incidental or other type of damages, in connection with the goods or services provided by any principal supplier booking through Omnia Travel's office or through this website, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligence, wilful acts, omissions or otherwise of such supplier, or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services, fuel increases, and other matters outside of Omnia Travel's control, and you hereby exonerate Omnia Travel from any liability with respect to the same. Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of Omnia Travel's control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by Suppliers and your travel insurance company, which is beyond the control of Omnia Travel. Omnia Travel reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time. Omnia Travel shall not assume any responsibility for any air and/or ground schedule changes. Omnia Travel has solely received commission and fees for travel transactions and customer agrees and understands that any recovery from Omnia Travel will be limited to the commission and fees paid by customer actually received by Omnia Travel.

The information, products, and services provided by us, our Suppliers or published on our website may include different inaccuracies or errors, including pricing errors. Omnia Travel reserves the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, the Customer will be offered to keep the pending reservation at the correct price or to cancel the reservation without penalty.
    
Information about products, hotel category, services, amenities are to be used as general guidelines, and its accuracy is not guaranteed by Omnia Travel.

PRICING

Unless otherwise mentioned, prices quoted in our offers or on the website are charged on per person basis, and do not include other expenses including, without limitation, gratuities to tour guides or drivers, passport or visa fees, travel insurance, food and beverage, accommodation, room services, telephone calls, gifts, optional excursions or laundry. The above-mentioned expenses are at sole responsibility of the passenger.

The published rates may change without prior notice, particularly in case of any unforeseen circumstance, such as increase in airline tickets, hotel rates, fuel and/or transport expenses.

HOTEL ACCOMMODATION & CHECK-IN - CHECK-OUT POLICY

Every effort will be taken to provide the accommodation in the preferred hotel. If this is not possible, Omnia Travel reserves the right to accommodate passengers in a hotel similar category and standard, before as well as after the booking confirmation has been received by the passenger.

Check-in and check-out policy depends on a property and will be specified in each booking confirmation. Early check-ins and late check-outs are at a hotel's discretion and can be subject to additional charge.

TRANSPORTATION LUGGAGE

Generally, for most Suppliers, only one piece of luggage and one hand luggage will be allowed for each passenger for transportation purposes. Omnia Travel reserves the right to charge for the additional luggage cost (as applicable).

PAYMENT

Unless otherwise defined during the reservation process, final payment is due prior to departure or consumption according to our Services and each Supplier's (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited.

We accept payment via bank transfer or credit card: Visa, MasterCard, Discover, JCB and Diners. In case of a credit card booking, Customers will be guided to the payment processing page where they can provide their credit card details and complete the transaction. After the payment is completed, Customers will receive a confirmation voucher via e-mail. This is the payment receipt that can be used for redeeming the tour package. Although every effort will be made to meet the booking requirements, please note that the travel arrangements are not confirmed until a written confirmation is received by Omnia Travel.

CANCELLATION/REFUND POLICY

Every service (Package/Tour/Attraction/Hotel booking/Transfer) has its own cancellation policies that will be outlined on the booking confirmation. It is the Customer's responsibility to read the cancellation policy before making any bookings on the website or through our agents.

All cancellations must be delivered in writing to Omnia Travel info@omniatravelco.com. Upon receiving the cancellation request, Omnia Travel will issue the confirmation of booking cancellation along with the cancellation penalties, as applicable, to be paid by Customers. If the Customer does not receive the cancellation confirmation the booking will still be considered as active and not cancelled.

In the event of cancellation, any potential refunds will be in accordance to the cancellation policy outlined on the payment receipt or booking confirmation. Customers entitled to refund will receive it after Omnia Travel has received the same funds from the supplier.

NO SHOW POLICY

In case that Customers do not show up for the confirmed attraction, tour, hotel booking, event, scheduled transfer, or any other service booked through the website or directly with Omnia Travel agent, there will be NO REFUNDS and NO RETURNS provided.

ITINERARY AMENDMENTS

Omnia Travel reserves the right to make minor amendments to the itinerary without prior notice and reimbursement to Customers. Tour packages are subject to change in case of flight changes, weather conditions, strikes or any force majeure events. In such cases, alternative package or route will be provided at a similar cost, based on the availability, without paying any penalties to the customer.
    
LATE BOOKINGS

Prospective customers are advised to reserve early to avoid disappointment and additional late booking fees.

NO REFUND FOR UNUSED TOUR ARRANGEMENTS AND MINIMUM PASSENGER REQUIREMENTS

As Omnia Travel's tour prices are based on contract rates, there will not be any refund for any unused portion of a tour. Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed or the tour may be cancelled.

CURRENCY FLUCTUATIONS

Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations, provided actual variations have occurred.

FORCE MAJEURE

"Force Majeure" means, in relation to Omnia Travel, any circumstances beyond the reasonable control of Omnia Travel, (including, but without limitation, acts of God, earthquakes, volcanic eruptions, floods, heat waves and other unforeseeable natural-caused incidents, wars, riots, chaos, slowdown and unexpected legislations).

Omnia Travel shall not be deemed to be in breach of these Terms and Conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. The purchase of travel insurance is highly recommended on all trips.

If Omnia Travel, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by Omnia Travel to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although Omnia Travel shall use its reasonable efforts to reimburse you where possible. However, Omnia Travel shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to Omnia Travel of the Force Majeure and applicable cancellation fees.

Once Omnia Travel has investigated the prevailing situation, as it deems fit, it shall remain in Omnia Travel's sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to Omnia Travel's and each supplier's terms and conditions.

COMPLAINTS AND INVESTIGATIONS

Customers must provide written notice to Omnia Travel at info@omniatravelco.com for any complaints and disputes within the 30 days from the completed Service. Any disputes received after the 30 days limitation in this section will not be taken into consideration.

All rights reserved. The information and images contained on this website, including downloadable files, are protected by copyright. All trademarks, logos and service marks ("Marks") displayed on our Services and in relation thereto are our property or the property of other third parties. You are not permitted to use these Marks without our prior written consent or the consent of such third party which may own the Marks.

PRIVACY POLICY

At all times your information will be treated in accordance with Omnia Travel's Privacy Policy, which is incorporated by reference into this Agreement and can be viewed at OUR WEBSITE: www.omniatravelco.com

GENERAL

These Terms and Conditions shall be governed and construed in accordance with the laws of the UAE for the time being in force. All claims and disputes (excluding claims for injunctive or other equitable relief as set forth below) in connection with these Terms and Conditions shall be amicably resolved between us within ninety (90) days from the date thereof. Failure to reach amicable settlement shall cause the dispute to be referred to and finally settled by the Dubai International Financial Centre (DIFC) courts.
    
These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Customer and Omnia Travel with respect to travel bookings made with Omnia Travel by any means accessing such information, including its' Web site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Customer and Omnia Travel with respect to communications with Omnia Travel, including the Omnia Travel website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
